Who provides QSO One

QSO One is made and run by Francesco (Frank) Catena, an individual based in Ohio, United States. It is not a company. In these terms, "we", "us" and "our" mean Frank, and "you" means you, the person using QSO One.

You can reach us at [email protected].

What these terms cover

QSO One is a free amateur radio app for Android, Windows, iPhone and Mac, together with the qso1.net website. These terms apply to all of them, which together we call "QSO One". By using QSO One you agree to these terms. If you do not agree, please do not use it.

Our Privacy Policy explains what data QSO One collects and how it is used. It is part of how QSO One works, so please read it too.

If you are under the age of majority where you live, you need a parent or guardian to agree to these terms for you before you use QSO One.

Your account

Some features need a QSO One account. Give accurate details when you sign up, keep your password and sign-in safe, and do not share your account. You are responsible for what happens under your account. If you think someone else has used it, change your password and tell us.

We can suspend or delete an account that breaks these terms, that is used to harm other people or QSO One, or that we are required by law to close. You can delete your own account at any time from the app or at qso1.net/account-deletion.

Amateur radio

Transmitting on amateur radio networks requires a valid amateur radio license. When you transmit through QSO One, you must hold a license that allows it and follow the rules of your country and the rules of each network you use. You are responsible for everything you transmit, including identifying with your own callsign.

Without a callsign on your account, QSO One is for listening and browsing only.

Networks we do not run

QSO One connects to networks and services that other people run, such as AllStarLink, EchoLink, DMR networks like BrandMeister and TGIF, System Fusion, M17, P25, D-STAR and more coming. We do not own or control them. Each has its own rules, and you must follow them. They decide whether you can use them, and they can change, limit or stop their service at any time. We are not responsible for their content, their availability or what they do with your information. Their names belong to their owners, and QSO One is not affiliated with or endorsed by them unless it says so.

What you post

QSO One lets you add things that other people can see: On the Net chat messages and check-ins, net listings and net details, and bug reports. You keep ownership of what you post. You give us permission to store, copy, display and send it as needed to run QSO One and show it to the people it is meant for. That permission ends when your content is deleted, except for copies that other people have already saved, such as a check-in in a net's log.

Do not post anything that is illegal, abusive, harassing, hateful, threatening, sexually explicit, spam, or that breaks someone else's rights or privacy. Do not pretend to be someone else, including using a callsign that is not yours. The On the Net chat rules also apply in live nets.

You can report content you think breaks these rules. We, and net control in their own nets, can hide or remove content, mute or remove people from a net, and we can ban accounts. We do not check everything that is posted, and we are not responsible for what other users post.

Using QSO One fairly

Do not misuse QSO One. That includes trying to break into it or other people's accounts, interfering with how it runs, overloading it or the networks it connects to, scraping it in bulk, or using it to do anything illegal. Do not copy, resell or reverse engineer the app except where the law allows it.

QSO One, its name, logo, app and website belong to us. Using QSO One does not give you any ownership of them. We give you a personal, non-exclusive right to use the app and website under these terms.

Supporter subscription and purchases

QSO One is free. Becoming a Supporter is entirely optional. It is a way to help pay for QSO One's servers and development, and it does not unlock any network, connection or core feature. Everything QSO One needs to work stays free.

You can become a Supporter through Google Play, the Apple App Store, or qso1.net/support (where payments are handled by Stripe or PayPal). A monthly subscription renews automatically each month until you cancel it, and the price is shown before you buy. Billing, renewal, cancellation and refunds follow the rules of the store or payment service you used:

  • Google Play: manage or cancel in the Play Store under Payments & subscriptions. Refunds follow Google Play's refund policy.
  • Apple App Store: manage or cancel in your Apple account settings (on iPhone: Settings > your name > Subscriptions). Refunds are handled by Apple.
  • qso1.net (Stripe or PayPal): cancel any time with the Manage / Cancel button in the QSO One app, in your PayPal account for a PayPal subscription, or by emailing [email protected]. If you think you were charged by mistake, email us.

Deleting your QSO One account does not cancel a subscription bought through Google Play or Apple. Cancel it in the store as well.

QSO One merch is sold through our shop at qso-one.printify.me, which is run by Printify. Merch orders, shipping, returns and refunds follow the shop's own terms.

Not for emergencies

Do not rely on QSO One for emergency communications or for anything where a failure could put someone's life, health or property at risk. QSO One depends on the internet, your device and networks that other people run, and any of them can fail without warning. In an emergency, contact your local emergency services.

No warranty

QSO One is provided "as is" and "as available", without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not promise that QSO One will always be available, free of errors, or work with every network, radio or device. We can change, pause or stop any part of QSO One at any time.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or missed contacts, arising from your use of QSO One or your inability to use it, even if we were told they were possible. Our total liability for any claim about QSO One is limited to the greater of the amount you paid us for QSO One in the 12 months before the claim, or 50 US dollars.

Some places do not allow some of these limits. Where that is the case, they apply only as far as the law allows, and nothing in these terms takes away rights you have by law as a consumer.

If you use the app from the Apple App Store

These terms are between you and us, not Apple. Apple is not responsible for QSO One or its content, and has no obligation to provide any maintenance or support for it. If the app fails to meet any warranty that applies by law, you can tell Apple, and Apple may refund what you paid for the app; to the fullest extent the law allows, Apple has no other warranty obligation for it. Apple is not responsible for any claim by you or anyone else about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, or claims that it infringes someone's intellectual property. We, not Apple, are responsible for dealing with those claims.

You confirm that you are not in a country subject to a US government embargo or listed as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties. You must also follow the terms of any third-party service you use with the app, such as your mobile carrier or internet provider. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you. Apple's own Licensed Application End User License Agreement also applies, and where it conflicts with these terms, these terms apply as far as Apple allows.

Ending your use

You can stop using QSO One and delete your account at any time. We can suspend or end your access if you break these terms, if we have to by law, or if we stop offering QSO One. The parts of these terms that by their nature should last after that, such as ownership, the warranty disclaimer, the limits on liability and governing law, still apply.

Changes to these terms

We may update these terms from time to time. When we do, we will change the date at the top of this page, and for a big change we will try to let you know in the app or by email. If you keep using QSO One after a change, that means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law rules. Any dispute about them or about QSO One will be handled in the state or federal courts located in Ohio, unless the law where you live gives you the right to bring it in your own courts.

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part of these terms straight away, we can still enforce it later. These terms, together with the Privacy Policy, are the whole agreement between you and us about QSO One.
